Terms of use

1. Use of holiday apartment.

The subletting and non-residential use of the holiday apartment are not permitted. Events and parties are only permitted with the written permission of the owner. A party will only be permitted when both apartments are also rented at the same time.

The Schamper Mühle is a converted 19th century windmill. The stairs are steep and open to the living spaces. Children must be supervised accordingly. Some of the original timber beams are lower than 2 meters above the floor. The apartments are not suitable for persons with physical disabilities and/or movement difficulties and for large dogs.

2. Booking and conditions of payment.

Upon receipt of your booking request and a check of the requested booking period, you will receive a rental agreement to sign and an invoice for the deposit. The final reservation of the apartment takes place on receipt of the signed rental agreement and the deposit.

The deposit is 20% of the total price (excluding cleaning charge and food basket, if applicable) 

The remaining amount is to be paid 3 weeks before arrival at the latest.

3. Arrival and departure

The holiday apartment is available from 4pm on the day of arrival or at a time in agreement with us. The apartment is to be vacated before 10am on the departure day or in agreement with us.

 4. Damage and loss of keys

The apartment will be handed over in a clean and orderly condition with a complete inventory. If defects are discovered or occur during the rental period, the landlord is to be informed immediately. The tenant is liable for any damage that he causes to the property and its contents. The tenant is liable for the cost of lost keys.

5. Smoking

Smoking is not permitted in the apartment.

6. Pets

Pets are only allowed in the apartment with the written agreement of the landlord. The apartment is not suitable for large dogs because of the steep stairs.

7. Cancellation by the tenant & compensation.

If the tenant cancels the rental agreement, he must pay the landlord compensation. The cancellation must be confirmed in writing. The amount of compensation is calculated as follows:

• up to 3 weeks before arrival: the amount of the deposit,

• 3 weeks before arrival up to arrival: 100% of the total price, excluding the cleaning charge and the cost of a food basket, if applicable.

7.1 Cancellation due to the corona epidemic.

We will refund 100% of the total price, when a cancellation results because of a legally binding travel ban or ban on overnight stays. No refunds will result if either 2g (vaccinated, recovered) or 3g (vaccinated, recovered, tested) travel restrictions are imposed. Refunds will not result because of any other restrictions due to the corona epidemic (for example: restaurant & catering restrictions, evening curfews, etc.)

If a guest is forced to quarantine because of a positive Corona test, then the landlord will attempt to find an alternative tenant and make a refund. No refund will be made if an alternative tenant cannot be found.

8. Cancellation by the landlord.

In the case of a cancellation by the landlord because of an Act of God or some other unforeseeable event, the liability of the landlord is restricted to a refund of the rental cost.

9. Liability of the landlord

The landlord is responsible for the orderly preparation of the apartment. Excluded is, for example, liability for possible failure or disruption of water or the electrical power supply, as well as the consequences of Acts of God.

10. Use of the Internet via WLAN

10.1 Permission to use the Internet via WLAN

The Landlord maintains internet access via WLAN for both holiday apartments. He allows the tenant to use this access for the length of his stay in the apartment. The landlord does not guarantee the actual availability, suitability or reliability of internet access for a particular purpose.

10.2 Danger of WLAN use, liability limitation.

The tenant is warned that the WLAN only allows access to the internet. Virus protection and a Firewall are not provided. Data communication is unencrypted.

10.3  Internet pages subject to the payment of a fee

If the tenant visits internet pages that are subject to the payment of a fee, or enters into agreements via the internet, he is responsible for any costs that result from such agreements.

11. Charcoal barbecue

The landlord has provided a charcoal barbecue for the use of the tenant. The tenant is responsible for the proper and safe use of this barbecue. The barbecue must not be left unattended when in use.

12. Clearance of snow and ice

Snow and ice will not be cleared by the landlord. Entering and driving within the property is at one’s own risk.
